Explainer

The document only works if it is made before it is needed

A power of attorney cannot be created once somebody has lost capacity. At that point the alternative is a court application taking months and costing far more.

The two kinds

One for property and finances, one for health and care. They are separate documents and most people need both.

The timing

It must be made while you have capacity. Doing it at forty is unremarkable; doing it after a diagnosis is often too late.

The cost

Registration is about eighty-two pounds per document, or free if you are on a low income. It does not require a solicitor.
